Death penalty for Staff Sgt. Bales? Not likely.

WASHINGTON (AP) ? Defense Secretary Leon Panetta says the death penalty is possible if a U.S. military court finds an Army staff sergeant guilty of gunning down Afghan children and family members. But it isn't likely.

History shows that the U.S. military system is slow to convict Americans, particularly service members, of alleged war crimes. And when a punishment is imposed, it can range anywhere from life in prison all the way down to house arrest. Other factors can seem to play more of a role than the crime itself.

In the case of Army Staff Sgt. Robert Bales, the suspect in the March 11 Kandahar shootings, legal experts say the 38-year-old married father of two young children could face a lengthy prison sentence if convicted of the crime, which has threatened U.S.-Afghan relations. But on his fourth combat tour and with a head injury on his record ? the sergeant remembers little about that night, Bales' lawyer says ? he might well be shown some leniency by the military jury, even if convicted.

"Political pressure is going to drive the push for the death penalty. Doesn't mean they're going to get it," said Charles Gittins, a Virginia-based defense attorney who represents service members and has handled capital cases.

Of the long list of alleged U.S. atrocities ? from prison massacres in World War II to the slaughter of civilians at My Lai in Vietnam ? relatively few high-profile war crimes believed to involve Americans in the past century have resulted in convictions, let alone the death penalty.

In the case of My Lai, President Richard Nixon reduced the only prison sentence given to three years of house arrest. In the 2005 Haditha shooting of Iraqi civilians, eight Marines were charged but plea deals and promises of immunity in exchange for testimony meant no prison sentences.

Prosecution against Blackwater employees in the 2007 shootings in Baghdad's Nisoor Square similarly floundered as civilian prosecutors tried to assemble the case. Charges eventually were thrown out on the grounds that prosecutors mishandled evidence, although a federal appeals court last year resurrected the case.

Legal experts say a big part of the challenge is assembling forensic evidence and eyewitness testimony from remote, often dangerous parts of the battlefield thousands of miles away from the United States. And there's an emotional component, too, in prosecuting U.S. citizens who have risked their lives in combat.

"Terms like 'fog of war' mean nothing legally," said Eugene Fidell, who teaches military law at Yale University. "But there's a reluctance to invoke the full moral sanction of criminal justice in these cases."

The military hasn't executed a service member since 1961. And like that case in 1961, in which an Army ammunition handler was hanged for raping an 11-year-old girl in Austria, none of the six men on death row at Fort Leavenworth, Kan., today were convicted for atrocities against foreign civilians. All of their crimes involved the killing of U.S. civilians or fellow service members.

The military doesn't even have the equipment necessary to carry out an execution. If a service member were to be put to death, the military would rely on the federal penitentiary in Terre Haute, Ind.

Of note is that U.S. service members ? as well as contractors supporting them in war zones ? are subject to a different set of rules than civilians when it comes to capital punishment. Unlike in the civilian world, the president must personally agree to the death sentence of a service member.

Gittins estimates that since 1961, more than half of the death penalty cases involving U.S. service members have been overturned by military appeals courts. He attributes that high percentage in part to the lack of experience that military judges and prosecutors have in pursuing capital cases. Inexperience means making mistakes, he says, which higher courts use to knock down rulings.

"If someone does two (military death penalty cases) in their entire career, that would be miraculous," he said. The question Panetta and others will have to ask, Gittins says, is whether pursuing the death penalty for Bales is worthwhile, given the likelihood such a punishment wouldn't stick anyway.

Human Rights Watch in Washington, which opposes the death penalty, says it's not clear the U.S. has the political stomach to follow through with the prosecution of war crimes involving its own citizens.

Andrea Prasow, the organization's senior counterterrorism counsel, said there was only one word to describe America's track record for punishing war crimes: "abysmal."

She says she is most troubled by a lack of accountability in suspected abuse of detainees, including the Abu Ghraib prison scandal in Iraq and secret interrogations led by the CIA.

"Every time a case is not prosecuted, it contributes to a culture of impunity," Prasow said.

Much of U.S. policy in recent years has focused on protecting troops from prosecution by foreign states. In the 1990s, the U.S. objected to the creation of an international court to prosecute war crimes, in part because of the potential that such a court might try to claim jurisdiction over American troops fighting abroad.

And while Congress in 1996 agreed that the standards for treating prisoners of war as outlined by the Geneva Conventions should be put into law, lawmakers revised the rules 10 years later under pressure by the Bush administration out of concern that U.S. interrogators could be prosecuted for alleged war crimes.

The U.S. also has insisted on maintaining immunity from local prosecution for its troops in Iraq and Afghanistan, signing specific agreements with those countries that preserve the military's legal jurisdiction in all cases involving service members.

While the U.S. track record for prosecuting alleged war crimes is spotty, some say the tide is changing.

In one 2006 case, four soldiers were given substantial prison sentences for raping a 14-year-old Iraqi girl and killing her and her family. Steven Dale Green, a former 101st Airborne soldier, is serving five life terms after jurors couldn't agree on whether to impose the death penalty.

Stephen Carter, a Yale law professor who writes frequently about the ethics of war, notes that many of the cases that are prosecuted are aided by other service members tipping off authorities.

"Nearly all of our military forces serve with enormous honor and courage. It bears mention that at Abu Ghraib, just as at My Lai, it was fellow soldiers who blew the whistle on the perpetrators," Carter wrote in a Newsweek Magazine editorial.

In 1962, Russian Eugene Andreev completed a jump from 80,380 feet. Baumgartner's plunge on Thursday came at 71,581 feet.

The test was designed to take Baumgartner into a region above the Armstrong line, an altitude of between 62,000 and 63,500 feet named for a former US Air Force flight surgeon-general who is widely considered the father of space medicine. The Armstrong limit is the highest altitude a human can reach and survive outside a pressurized environment ? either a cabin or suit. At that altitude, the atmosphere's pressure is so low that water boils away at a human's body temperature. Outside temperatures hover around minus 75 degrees Fahrenheit.

A space-suited Baumgartner rode to his jump altitude in a pressurized capsule that dangled below a 165-foot-tall helium balloon.

The ascent went flawlessly, according to the project's sponsors, Red Bull USA, an energy drink producer. During Baumgartner's 3-minute, 33-second free-fall, he reached a speed of 364.4 miles an hour. He opened his parachute when he was just under 8,000 feet above the New Mexico desert.

As warm weather collides with cold fronts, the sharp temperature differential creates unstable weather conditions. At the same time, meteorologists say the Gulf of Mexico is slightly warmer than normal, providing the kind of moisture that can result in dangerous thunderstorms.

?This year conditions are more conducive than normal for extreme weather,? says Joe Lundberg, senior meteorologist at AccuWeather.com in State College, Pa. ?We are getting off to an early and nasty start.?

He would get no argument from the residents of the central and southeast US where many extreme weather events take place. In February, according to the National Oceanic and Atmospheric Administration, 57 tornadoes were reported, nearly twice the 1991-2010 average of 29. The extreme weather has continued into March. For example, last week in southern Indiana, 13 people died after an F4 tornado ? one of the largest ? caused massive destruction.

Last year was a bad season for tornadoes as well with nearly 1,700 of the storms. In a more normal year there are 1,300 tornadoes.

The extreme weather is expected to continue possibly as early as late this coming weekend or early next week, says Mr. Lundberg. ?From the Rockies through to the Plains, there could be another system with a lot of severe weather,? says the meteorologist. ?The window we are looking at is Sunday through Tuesday.?

Nor is that likely to be end of the extreme weather, Lundberg says. He expects the abnormally warm weather to persist through March and possibly into the beginning of April before the temperatures start to get closer to normal. ?What we think will eventually happen is the weather will shift towards a drier pattern, especially farther west,? he says. ?We are not sure when that will happen, but it should start to stabilize the weather patterns.?

Venizelos is expected to?resign from his post during the week, between March 15-17th.?A new Finance Minister will undertake important duties until the parliamentary elections that will most likely take place in upcoming May. On Monday morning, there are rumorsthat PM Lucas Papademos will also take the post of the Finance Minister until the ealry elections.

With the signing of the second bailout agreement Papademos government will have completed its duty. Theoretically, the date for the early elections should be declared?. this week? next week?

The confusion concerning the emergency property tax continues. The Finance Ministry claimed that when consumers pay only the electricity consumption amount, this money goes to the state as ?emergency property tax?. State power company DEH claims otherwise. Go figure?

As the state is in dire need of money, it will send control units to live music halls and fine them for allowing?smokingwithout paying the ?smoking fee?. Big music halls have to pay a fee so that their customers smoke while enjoy music. The finance ministry had estimated to cash 40 million euro from the smoking fee, however the revenues had not exceeded the two million.

Health ministry will?fine doctors with one euro for every prescription they write per hand and not electronically. The last stand at IKA (3 months ago) was that the doctors did not have computers available to write electronically the prescriptions. The Ministry was asking them to buy laptops out of their own pockets. The Greek Physicians Federation strongly opposes this measures, speaks of ?attempts to terrorize the doctors? and claims that the electronic prescription system does not work properly.

The cabinet is meeting to take decisions for the parades at the national day, March 25th. The prime minister and the ministers are on high alert as the incidents of angry citizens ?attacking? politicians with yogurt are dramatically increasing.

Anxiety, much like panic attacks, is caused by feelings and thoughts. This is where it gets even harder to treat anxiety, as it is one challenge for sufferers to realize that they have a condition, but to identify within themselves the origins of their condition is even harder.

The key lesson here on how to cure anxiety sounds very simple, but in practice, it is not. Step one is to realize that you are a sufferer, not because you are convinced of it by others, but because you realize that you have a problem and you accept that you have a problem. Step two is to understand the feelings that cause your feelings of anxiety, and accept that they are not capable of hurting you, nor should you feel threatened by them. This is the hardest part of curing anxiety, as these thoughts are often extremely hard to face.

To conclude, I will mention that Anxiety is a serious condition. Whilst there are groups out there that can help you get through this, it is always a very wise choice to speak to your doctor about the possible treatments that are available. Medications may be a viable choice for you, especially in order to help you face the short term challenges that lead to a long term cure. Many people do beat panic and anxiety without the need to resort to medication however. It is all a matter of how you approach your condition, how capable you are of taking ownership of the situation, and how dedicated you are to be well.

Today, divorce is commonplace. ?Various studies conclude that just over 50 percent of all marriages end in divorce. ??It is also estimated that the divorce rate is around 60% for second marriages. Divorce can have a devastating emotional impact on both spouses, as well as for children who are caught in the middle. ?Aside from the emotional consequences of a divorce, a divorce can also have a significant financial impact on both spouses. Divorce typically leaves at least one, and often both, spouses in a worse financial situation than before the divorce. If you have recently been through a divorce, or are currently in the middle of one, it is critical that you also consider the effect of the divorce on your estate plan.

A number of estate planning documents should be reviewed and amended incident to a divorce. ?Most people will want to remove an ex-spouse as a beneficiary under their will or trust. ?If you have minor children, you should also consider appointing one or more people as potential guardians of your children in the event your ex-spouse becomes incapacitated or passes way. ?Retirement plans and life insurance policies may also need to be changed in order to remove your ex-spouse as the beneficiary.? While many state?s laws automatically remove your ex-spouse as beneficiary under your will, trust, retirement plans and life insurance policies, you should make the actual changes so there is no question who you intended to receive your estate and to avoid your family having to take a likely trip to court.? Lastly, durable powers of attorneys for both property and health care decisions should be reviewed and amended to remove an ex-spouse from having decision making authority under these documents.

Some of the changes described above should be considered and completed even before your divorce is finalized. ??However, caution needs to be exercised because certain actions, such as changing beneficiary designations on life insurance policies and retirement plans or transferring assets out of a trust, is forbidden under?the?divorce laws of most states.? Any changes to your estate plan incident to a divorce should only be done at the direction of both your divorce and your estate planning attorneys.
